Hung Shui Kiu/Ha Tsuen New Development Area Second Phase Development – Contract 6 – Site Formation and Engineering Infrastructure Works

Description :

The works mainly include:
  1. site clearance and formation (including land decontamination works) for about 62 hectares of lands, together with provision of associated engineering infrastructure;
  2. construction of district distributor and local roads connecting Hung Shui Kiu/Ha Tsuen New Development Area to Ping Ha Road and Ha Tsuen Road;
  3. construction of a sewage pumping station;
  4. construction of associated works including water mains, drainage and sewerage works, cycle tracks, footpaths, box culverts, slope works, retaining structures, street furniture, landscaping works, electrical and mechanical works and other ancillary works; and
  5. implementation of environmental mitigation measures (including noise barriers) and environmental monitoring works for the works mentioned above.
The works are scheduled to commence in mid-2025 and will take about 55 months to complete.

Submission of Tenders :

A tenderer must submit its tender in electronic format via the Electronic Tendering System for works contracts ("e-TS(WC)"). Late submission will not be accepted.

In addition to the electronic submission, a tenderer may opt to submit its tender in hard copy as well. Submission in hard copy is optional and it will not be used unless falling within the exceptions stated in the conditions of tender. If a tenderer opts to submit a hard copy tender in addition to electronic submission, the tender must be sealed, clearly marked with the tender reference and the subject of the tender on the outside of the envelope (but should not bear any indication which may relate the tender to the tenderer) addressed to the Chairman, Central Tender Board and placed in the Government Secretariat Tender Box located at the lobby of the Public Entrance on the Ground Floor, East Wing, Central Government Offices, 2 Tim Mei Avenue, Tamar, Hong Kong. Tenders must be deposited in the tender box as specified in this tender notice ("Specified Tender Box") before the tender closing time. Late tenders and tenders not deposited in the Specified Tender Box will not be accepted.

The tender closing date may be extended under the following circumstances:-

  1. If tropical cyclone signal No. 8 or above, or a black rainstorm warning signal is hoisted or if "extreme conditions after super typhoons" announced by the Government is in force at any time between 9 am and 12 noon on the tender closing date, the tender closing time will be extended to 12 noon on the first working day after the tropical cyclone signal No. 8 is lowered, or the black rainstorm warning signal or the "extreme conditions after super typhoons" announced by the Government has/have ceased to be in force. Saturday is not counted as a working day. The announcements on "extreme conditions after super typhoons" will be made via press releases website of the Information Services Department (http://www.info.gov.hk/gia/general/today.htm);

  2. If there is a blockage of the public access to the location of the Specified Tender Box at any time between 9 am and 12 noon on the tender closing date, the Government will announce extension of the tender closing date and time until further notice. Following removal of the blockage, the Government will announce the extended tender closing date and time as soon as practicable. The announcements will be made via press releases website of the Information Services Department (https://www.info.gov.hk/gia/general/today.htm); or

  3. If there is any other reason which in the Government's view shall affect the close of tender, the Government will notify tenderers of the extension in tender closing date and time via the e-TS(WC) and/or emails.

Remarks :

  1. The tender to be invited is covered by the Agreement on Government Procurement of the World Trade Organization and will not involve electronic auction.
  2. The tender documents are included in the Electronic Dissemination Package ("EDP") which can be downloaded from the e-TS(WC) via this link https://www.gov.hk/en/theme/etendering/ets/. Hard copy of the EDP will not be issued.
  3. Regarding the use of e-TS(WC), tenderers should take note of the following:
    1. Prior to downloading tender documents, tenderers must register an account on the e-TS(WC).
    2. Certain electronic files required to be submitted with the tender require digital signature(s). Tenderers are advised to apply for the Organizational e-Cert in advance and ensure its validity.
    3. Tenderers are reminded to ensure that data transmission is completed before the close of tender.

  4. Selective tendering is adopted. Confirmed contractors on the List of Approved Contractors for Public Works in Group C under the Roads and Drainage Category or joint ventures with participation of local and/or overseas contractors with at least one of the participants or shareholders being a confirmed contractor on the List of Approved Contractors for Public Works in Group C under the Roads and Drainage Category, who also meet the following qualifications and other conditions for participation stipulated in the tender documents are invited to tender:
    1. The tenderer, or the participants/shareholders collectively in case of a joint venture tenderer, has completed at least one construction contract involving roads and drainage works with an adjusted contract value not less than HK$800 million, in or outside Hong Kong, within the past 10 years counting from the original date set for the close of tender. The adjusted contract value shall be the awarded contract value being adjusted to current price level as stipulated in the tender documents.
    2. In case of a joint venture tenderer, the requirement in either paragraph (1) or (2) below has to be satisfied:-

      (1) the lead participant or major shareholder is a confirmed Group C contractor included in the List of Approved Contractors for Public Works under the Roads and Drainage Category; OR

      (2) the lead participant or major shareholder is a contractor who is not enlisted in any service category under the List of Approved Contractors for Public Works and the List of Approved Suppliers of Materials and Specialist Contractors for Public Works. In this case,
      1. the total percentage participation of participant(s) or shareholder(s) who is/are confirmed Group C contractor(s) included in the List of Approved Contractors for Public Works under the Roads and Drainage Category is at least 40%; and
      2. the percentage participation of the lead participant or major shareholder is no more than 60%

        The detailed requirements for joint ventures with participation of local and/or overseas contractors, if applicable, are stipulated in the tender documents.
  5. Contractors not yet on the List of Approved Contractors for Public Works in Group C (Confirmed) under the Roads and Drainage Category may also submit a tender if they submit a request for participation together with a duly completed application for inclusion in the above-mentioned approved list/category by 22 January 2025 to Chief Engineer/West 2, West Development Office, Civil Engineering and Development Department on 9th Floor, Sha Tin Government Offices, 1 Sheung Wo Che Road, Sha Tin, New Territories, Hong Kong, meet the qualifications and conditions for participation, and the application for inclusion is duly approved on or before the tender closing date.   6. Contractors will be liable to have their names removed from the approved list(s) if they fail or refuse to implement an accepted tender.
  7. The Government of the Hong Kong Special Administrative Region does not bind itself to accept any tender irrespective of whether the tender is the lowest bid or where the assessment of the tenders is based on a marking scheme or formula approach, the tender has the highest overall score.
  8. The Government of the Hong Kong Special Administrative Region reserves the right to negotiate with any tenderer about the terms of the offer.
